Most policies treat seawalls very differently from the house. Learn what flood, homeowners and condo policies say before a storm, not after.

The essentials before you start

Does flood insurance cover a seawall?

No. The NFIP Standard Flood Insurance Policy lists “fences, retaining walls, seawalls, bulkheads, wharves, piers, bridges, and docks” as property not insured, in the Dwelling, General Property and condominium association forms alike. FEMA upheld an insurer’s denial of a seawall claim in Appeal Decision C31.

The flood policy also excludes damage caused by earth movement and gradual erosion, though it can pay for certain shoreline collapse caused by waves or currents beyond anticipated cyclical levels. Ask your agent how that applies to the soil behind your wall.

Homeowners policies: read “other structures” and the exclusions

Florida OIR distinguishes homeowners and condo forms; HO-3 coverage is subject to exclusions, and flood coverage is generally separate. Citizens describes its HO-3 as covering the building, other structures and personal property. The standard ISO HO-3 language excludes water pressure damage to a retaining wall or bulkhead that does not support a building, and to piers, wharves and docks.

In practice, a seawall may fall under “other structures” for some causes of loss and be excluded for others. Ask for a written answer that names your wall, the dock and the boat lift.

Wind damage and flood damage need separate evidence

If you have both wind and flood policies, notify both insurers; adjusters decide which portions of the damage come from each cause. Flood losses can come from storm surge, flash flooding or overflowing water. Wind-driven rain entering from above is treated differently.

Florida claim deadlines

  • Claim notice: within 1 year of the date of loss; supplemental claims within 18 months. For a hurricane, the date of loss is the landfall date.
  • Lawsuit: an action for breach of a property insurance contract must be filed within 5 years of the date of loss.
  • Hurricane deductible: insurers must offer $500, 2%, 5% and 10% options, applied once per calendar year.
  • NFIP: proof of loss within 60 days; appeals within 60 days of a denial letter. New flood policies usually take 30 days to start.

Build a claim file that helps

  • Pre-storm photos and the permit history for the wall, dock and lift.
  • Post-storm photos and video before cleanup, plus damaged samples where safe.
  • The inspector’s written findings and the repair scope with quantities.
  • Receipts for emergency protective measures, with before-and-after photos.

Grants and disaster aid rarely pay for seawalls

My Safe Florida Home grants are limited by statute to doors, windows, roof-to-wall connections and roof decking, so seawalls are not eligible. FEMA’s homeowner repair aid lists privately owned docks only as access to the home and does not list seawalls, and FEMA public assistance treats private property as the owner’s responsibility.

Condo owners: read the master policy and your own

Florida’s condominium statute makes association policies official records. NFIP’s condominium association form also excludes seawalls. Ask the association which report evaluated the seawall and whether reserves cover it; the condo guide covers the questions.
